Kimberlee Massin and Carrie Linden obtained dismissal of a claim where Plaintiff was not diligent in securing service of process on Defendant. Plaintiff claimed her nose was broken as a result of a bar fight. Kimberlee and Carrie filed a motion to dismiss with prejudice pursuant to Supreme Court Rule 103(b) as Plaintiff did not serve the registered agent for the corporation until 5 months, 7 days after the complaint was filed/initial summons was issued and after the one year condition precedent expired.
