Scott McKenna obtained dismissal with prejudice on behalf of their client, who was brought into the suit after the statute of limitations.  The plaintiff sought to relate the late pleading back to the original timely-filed pleading against the BVH client’s father, who was the owner but not the driver of the subject vehicle, but the Court ruled that the earlier suit was a nullity and thus relation back could not apply.
