Plaintiff alleged a fall down stairs caused by a lack of an attached railing in violation of the Chicago Building Code.  It was undisputed that the railing had fallen off or been torn off the steps prior to the incident, but BVh won summary judgment by arguing that Plaintiff failed to present sufficient evidence showing that any defect caused the fall.
