Scott McKenna obtained a very favorable settlement in favor of his client in a case alleging that his client braked suddenly and started a chain reaction accident resulting in a motorcyclist crashing his bike and suffering many fractured ribs and other internal injuries. The plaintiff sustained over $100,000 in undisputed medical bills and significant injuries requiring in-patient therapy to recover. The case settled for $22,500 after BVH was able to establish through witness testimony that, although the defendant did merge in front of the plaintiff in a sudden manner, the accident happened when the plaintiff took his hand off the handle bar to “flip off” the defendant and then lost control of his motorcycle when the defendant began to brake in a normal manner.
