Jury Verdict - Battery During Cemetery Altercation
Scott D. McKenna

February 2015
Scott McKenna obtained a favorable jury verdict following the trial of case where Plaintiff alleged he was attacked by Defendant during an altercation at a cemetery.

Plaintiff alleged Defendant assaulted and battered Plaintiff because he would not move out of the roadway in a cemetery to allow Defendant to leave.  Plaintiff claimed the incident caused an orbital fracture, corneal abrasion, and vision impairment.  The jury awarded Plaintiff a net award of only the amount of his medical bills, which was less than 4% of the amount Plaintiff asked the jury to award at the close of the trial.
