Lori Vanderlaan and Mathew Hargrave obtained summary judgment in favor of a concrete pumping company whose operator was alleged to have caused injury (over $400,000 in claimed damages) to Plaintiff during a concrete pumping and pouring operation at a large construction site on the south side.  Because of the admissions obtained by BVH at Plaintiff's deposition, after only 2 depositions (Plaintiff and the concrete pump operator), BVH moved for summary judgment on several bases, including the fact that Plaintiff had failed to establish a link between the injury alleged by Plaintiff and the actions of the concrete pump operator.  The appellate court agreed that summary judgment in favor of the concrete pumping company was appropriate and no further appeal was filed.
