Fritz Wilson obtained summary judgment on behalf of the firm’s client, a general contractor, who was contracted to replace gutters and downspouts in a subdivision where Plaintiff claims she fell and sustained personal injuries. Plaintiff contended that the gutter improperly discharged water onto a walkway where Plaintiff was walking, leading to her fall. Through discovery BVH developed evidence demonstrating that the client followed plans and specifications and complied with its contractual requirements with the other parties in the case in subcontracting the work. The Court granted summary judgment in favor of BVH’s client as well as its subcontractor in the case.
