Jim Best and Fritz Wilson recently won summary judgment in favor of the firm’s client in a case where the plaintiff alleged a slip and fall on an unnatural accumulation of snow and ice. The Plaintiff alleged that the Defendants were negligent in failing to maintain their property and for allowing an unnatural accumulation to form inside the property, allegedly causing the Plaintiff to fall down a flight of stairs. BVH was able to develop evidence that the fall was not caused by an unnatural accumulation or that there were any defects which could have contributed to the fall. The trial court agreed, and granted summary judgment in favor of BVH and against the Plaintiff, dismissing the case with prejudice.
