Plaintiff, a tenant of Defendant property owner, alleged that a manhole cover on the property was not properly maintained or affixed such that the plaintiff fell into the manhole after stepping on the cover and suffered significant injuries to his urethra and testicles requiring surgery.  BVH won summary judgment by arguing that Defendant had no notice of any defect on the property and Plaintiff could not prove that any defect existed.
