Summary Judgment - Animal Control Act
Alison M. Harrington and Fritz V. Wilson
August 2014
Alison Harrington and Fritz Wilson obtained summary judgment on behalf of their clients in a case where Plaintiff alleged injury resulting from an attack by Defendants' dog. Plaintiff sought to hold Defendants liable for the behavior of the dog under the Animal Control Act, which provides for liability against an owner of an animal that causes injury to others. Plaintiff claimed substantial permanent injuries and damages. Alison and Fritz were able to establish that Plaintiff herself could be considered an owner of the dog under the Animal Control Act, resulting in the case's dismissal and judgment entered in favor of Defendants and against the Plaintiff.
