Summary Judgment Affirmed on Appeal - Premises Liability
Scott D. McKenna and Christina M. Tribbia
Plaintiff claimed that Defendant's property was dangerous in that a no-longer-used metal vault lid existed in the sidewalk in front of the premises business, which caused it to become slippery when it snowed. Plaintiff claims a slip and fall on the lid during wintery conditions. BVH argued that the lid was not on Defendant's property and further that Plaintiff could not identify any specific defect that caused the fall. The trial court agreed and granted summary judgment, and the appellate court affirmed the judgment.
