Lori Vanderlaan and Thomas Costello successfully defended a trip and fall claim asserted against one of BVH’s restaurant clients. During Plaintiff’s deposition, Tom and Lori were able to establish that the allegedly dangerous condition on which Plaintiff claimed to fall was less than two inches, and thus de minimis. They were able to establish other defenses during discovery, which led to their ability to convince Plaintiffs to accept a nuisance value settlement prior to filing summary judgment, in order to save BVH’s client even the relatively minimal expense of the same.
