Dismissal with Prejudice – Premises/Altercation
Fritz Wilson and Sarah Jin
May 2018
Fritz Wilson and Sarah Jin secured a dismissal with prejudice on behalf of a business client where the Plaintiff, a police officer, contended that the establishment negligently supervised employees and customers leading to an altercation. BVH secured a dismissal with prejudice without having to conduct discovery by identifying case law showing that plaintiff was barred from suit based on the fireman’s rule because the claimed injury was inherent in the risk of Plaintiff’s profession as a police officer.
