Scott McKenna obtained dismissals on three consecutive Complaints naming their municipal client where Plaintiff claimed that Defendant Village violated her rights to Due Process, Equal Protection and Free Association when allegedly a municipal employee broadcast a robocall to Village residents on the eve of a municipal election announcing that the plaintiff was not a proper candidate for the office for which she was running. Scott argued that Plaintiff failed to plead viable or legally recognizable claims under those theories. After three failed attempts to plead such claims, Plaintiff dropped their Village client from the suit.
