James Best and Fritz Wilson obtained a dismissal with prejudice on behalf of one of the firm’s clients where the Plaintiff claimed she fell due to unsafe stairs and due to an unnatural accumulation. Through the course of discovery BVH developed evidence that Plaintiff could not identify the cause of her fall and successfully established that there was no defect or unnatural accumulation. BVH moved for summary judgment in the Circuit Court of Cook County and prevailed. Plaintiff appealed the result, and the First District Appellate Court affirmed, upholding summary judgment in favor of BVh's client.
