04/20/2012In April of 2012, Scott McKenna and Christina Tribbia were able to obtain a favorable settlement for their client in an auto negligence case where the plaintiff was alleging several lumbar surgeries, including a diskectomy and fusion, which resulted in about $400,000 in medical expenses.
The plaintiff was alleging that Scott and Christina's client cut off the plaintiff while merging onto a highway in a construction zone, which caused the plaintiff to slam on her brakes and get rear-ended by a co-defendant truck. Scott and Christina argued at mediation that both the plaintiff and the co-defendant were fully at fault for the accident, that Plaintiff had unnecessary medical care and that plaintiff's injuries were related to pre-existing conditions and not the accident at issue. The case ultimately settled for $600,000 total, with Scott and Christina's client only responsible for $100,000 of that amount.
