Defendant’s employee allegedly sexually battered, harassed, and made threats against a public housing recipient whose home he was inspecting at the time. Defendant successfully moved to dismiss the Illinois Gender Violence Act claim, establishing that the Act did not impose liability upon corporations, but only individuals. Thereafter, Defendant won summary judgment as to all remaining claims, including a claim pursuant to the Illinois Civil Rights Act of 2003 , for which there was no reported Illinois case law on point as to the issues or conduct raised in the complaint, requiring BVH to create an argument based upon both the statute on its face as well as Illinois and federal housing and discrimination case law.
