Punitive Damages Disallowed - Dog Attack
Alison M. Harrington, Fritz V. Wilson, and Timothy P. Peterson

April 2015
Alison Harrington, Fritz Wilson, and Timothy Peterson obtained a favorable ruling disallowing a claim of punitive damages in a case alleging significant injuries from a dog attack.  Plaintiff sought to amend the Complaint to seek punitive damages after conducting discovery in a case where Plaintiff alleged a dog attack led to significant injury.  The Motion was opposed on the basis that punitive damages were not favored in the law and that the evidence presented did not support that the alleged conduct warranted punitive damages.  The Court agreed and punitive damages were disallowed.
